摘要： 自動(dòng)化決策算法在商業(yè)領(lǐng)域的應(yīng)用日漸廣泛，算法治理成為法學(xué)研究的熱點(diǎn)。在算法治理探索的路徑上，算法解釋權(quán)的引入具有重要意義。我國(guó)《個(gè)人信息保護(hù)法》第24條第3款規(guī)定了具有中國(guó)特色的算法解釋權(quán)，但在權(quán)利構(gòu)造上依舊模糊。因此需要圍繞算法解釋權(quán)的構(gòu)成要件展開(kāi)分析，從主體、時(shí)間和內(nèi)容三個(gè)方面著重討論算法解釋權(quán)的適用機(jī)制，有助于為算法解釋權(quán)適用提供充分的理論依據(jù)和具體的操作指引。

Algorithm explanation rights: controversial empowerment, application logic and application mechanisms

Abstract： Business automation decisions are widely used in the the commercial field, and algorithm governance becomes a hot topic in theoretical research. In the path of algorithm governance exploration, the introduction of algorithm explanation rights is of great significance. Paragraph 3 of Article 24 of Personal Information Protection Law stipulates the right to explanation of automated decisionmaking with Chinese characteristics, but the institutional construction of rights is still vague. Therefore, it is necessary to analyze the constituent elements of the right by taking account of the subject of rights, explanation content of rights and application time of rights. It can help to provide sufficient theoretical basis and specific operational guidelines for the application of the algorithm explanation rights.

引言
2022年我國(guó)數(shù)字經(jīng)濟(jì)規(guī)模達(dá)到50.2萬(wàn)億元，作為數(shù)字經(jīng)濟(jì)的核心技術(shù)，算法對(duì)人類的生存、生產(chǎn)和生活方式產(chǎn)生了全方位的深遠(yuǎn)影響。飛速發(fā)展的算法技術(shù)在便利生活的同時(shí)也帶來(lái)新的社會(huì)問(wèn)題，如算法黑箱、信息繭房等。為解決算法引發(fā)的新型規(guī)制難題，國(guó)內(nèi)外學(xué)者圍繞算法治理積極開(kāi)展研究，提出新型權(quán)利算法解釋權(quán)來(lái)規(guī)制算法自動(dòng)化決策的。盡管算法解釋權(quán)存在爭(zhēng)論，但算法解釋權(quán)在破解算法黑箱，抑制算法權(quán)利上有著重要意義。通過(guò)深入剖析算法解釋權(quán)的適用邏輯和適用機(jī)制，平衡效率與公平，讓算法解釋權(quán)在算法治理中發(fā)揮其應(yīng)有的功能。
